When booking your activity with 296 Iates, Lda. you are accepting the Terms and Conditions below.
Reservations
All activities provided by 296 Iates, Lda. can be booked through the channels intended for this purpose, such as the website, email or telephone. Reservations will only be considered valid after confirmation by our team, through receipt of a reservation validation.
Atmosphere conditions
Activities may be conditioned by adverse weather conditions. 296 Iates, Lda. reserves the right to change itineraries, schedules or even cancel the activity, if conditions compromise the safety of individuals.
Cancellation by the customer
The cancellation of the reservation can be made under the following conditions:
- If you cancel up to 30 days in advance, from the start time of the activity, you will receive the full amount paid;
- If you cancel up to 15 days in advance, counting from the start time of the activity, you will receive 50% of the amount;
- Cancellations after the aforementioned periods will not be refunded.
Prices
The prices presented by 296 Iates, Lda. include VAT at the legal rate in force. These are presented in Euros € (local currency). 296 Iates, Lda. is not responsible for currency fluctuations or any additional fees outside the company, such as bank transfer fees, credit card fees, among others.
Meeting point
The activities provided by 296 Iates, Lda. have as a meeting / check-in point at Marina da Horta, located on Faial Island.
Navigation
Navigation in the Azores is only allowed, in areas previously agreed with our team.
Boat Rental
Boat rentals will preferably be done with a skipper from 296 Iates.
The rental of vessels without a skipper from 296 Iates may be considered, provided that the hiring of a skipper for free navigation purposes is duly validated and approved by the 296 Iates team. This type of rental requires a deductible payment and the value of hiring a skipper is not included in the price of the contracted package. It is not allowed to return the vessel on any basis other than that established for check-out purposes.
Deductible Payment
The deductible payment is mandatory in case of boat rental without skipper from 296 Iates. This is intended to cover any costs that are not covered upon shipment.
After the rental, if there is no damage or loss to the vessel or its equipment, 296 – Iates, Lda. will proceed with the full refund of the deposit given. However, if there is any damage and/or loss, we will only be able to return the possible remaining amount of the deposit after fully evaluating the costs of repairing the damage and/or loss that have occurred and proceeding with the respective deduction. The deductible covers, but is not limited to:
- Loss and/or damage caused to the vessel, equipment and liability of third parties;
- The loss and/or damage of the equipment included in the inventory delivered by 296 – Iates, Lda. to the customer at check-in;
- Costs incurred if the vessel is returned in an unacceptably dirty condition;
- The cost of returning the boat to the pre-established port, in case the customer does not do it on the scheduled date and time.
- The cost of refueling if the boat is returned without the tanks refilled.
Vessel Safety Requirements
All safety equipment on our vessels meets or even exceeds the safety standards established by Portuguese law.
All vessels are fully equipped for the available activities.
Capacity / Capacity
Our boats have capacity for 10 and 20 people.
All individuals are considered in the count, regardless of age.
Children under the age of 18 must be duly accompanied by an adult, who is responsible for the minor. Neither the skipper nor the crew on board will be responsible for your child.
Onboard Activities
The passenger is obliged to follow all the directions provided by the skipper during the period established for the activity.
If the skipper considers that the activity cannot be continued, for any reason that compromises the safety of the individuals on board, he reserves the right to terminate it at any time.
Activities in General
We reserve the right to cancel any tour or activity without prior notice.
If the minimum number of individuals required for the available activities is not reached, we reserve the right to postpone or cancel them.
296 Iates, Lda. is not responsible for any physical damage that may occur to individuals during the activities, nor for damage caused to any material property during the period underlying the activity.
Delays and No Shows
If you are late and have not provided any prior notice to our team, the established grace period is 5 minutes after the established time for check-In. After this time, we will consider that you did not attend the activity and the amount will not be refunded.
If you do not attend the activity, you will not be refunded.
lost objects
We are not responsible for belongings left on the boats or in any means of transport provided by 296 Iates, Lda. You can, however, contact our team to try to understand if they found your belongings.
Tickets and Other Costs
296 Iates, Lda. is not responsible for paying entrance fees to museums and parks, or for other costs that are not stipulated in the contracted program.
Sickness on board
If you are feeling nauseous, we recommend taking a pill suitable for nausea, which you should have with you. We do not provide any medication nor will we reimburse you if you are seasick.
Influence of Footwear on the Vessel
You must wear footwear suitable for the activity, so as not to damage the boat.
If you don’t own this type of footwear, opt for soft-soled sneakers, preferably white. Common shoes should not be used (boots, high heels, etc.), as they damage the floor of the vessel.
Travel itinerary
If the travel itinerary suggested by 296 Iates, Lda. is not to your liking, you must communicate your dissatisfaction before accepting it. Upon accepting the program, we will not reimburse you if the trip did not meet your expectations.
